Case Summary: Elderly mother and disabled adult daughter lived together in mother’s home. Ill mother placed in SNF for 24/7 medical care and is conserved.
Mother’s Conservator sells home, resulting in sales proceeds. Conservator/Trustee purchased immediate annuity for income stream (without Trustee’s management fees) for mother. Annuity income (less $35/mo) was SNF resident’s Share Of Cost.

Adult Daughter still needs place to live and care plan, has limited abilities but does not qualify for SSI, does not need a Conservator (per PVP); does need income.

Professional Opinion: Child Support from Parent to Child is allowed by Welfare & Institutions Code; Expert Witness testimony prepared for 2 PVP Attorneys with P&A’s and Declaration for Court regarding CHILD SUPPORT ORDER for DISABLED ADULT CHILD.

Judgment granted: $1,500/month Child Support Order granted, continuing Mother’s prior support of her Adult Child; legal effect was to reduce Share Of Cost pro rata, enabling Adult Child to live independently as long as possible.
